This policy follows the Digital Millennium Copyright Act (17 U.S.C. 512). It is part of our Terms of Service.
How to send a takedown notice
Email your notice to [email protected] with the subject DMCA. One notice can cover several items. We do not accept notices through comments, forum posts or messages to creators.
If you are a creator on OnlyThroat and your content has been reuploaded by another account on the platform, use the same route.
What a valid notice must contain
- Your physical or electronic signature, or that of a person authorised to act for the copyright owner.
- A description of the copyrighted work you believe is infringed, or a list if the notice covers several works.
- The exact links on onlythroat.com to the material you want removed, so we can find it.
- Your name, mailing address, telephone number and email address.
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
Incomplete notices may delay removal. We will tell you what is missing.
What happens after we receive a notice
We review the notice, remove or disable access to the material when the notice is valid and inform the account holder who posted it, including a copy of the notice with your contact details, as the law allows. We may ask for further information if the notice is unclear.
Sending a notice that knowingly misrepresents infringement can make you liable for damages under 17 U.S.C. 512(f).
Counter notice
If your content was removed and you believe this was a mistake or that you have the right to use it, you can send a counter notice to [email protected] with the subject DMCA counter notice. It must contain the following.
- Your physical or electronic signature.
- The material that was removed and the link where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address, or if your address is outside the United States, any judicial district in which the service may be found, and that you accept service of process from the person who sent the original notice.
We forward a valid counter notice to the person who sent the original notice. If they do not inform us within 10 to 14 business days that they have filed a court action, we may restore the material.
Repeat infringer policy
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. A creator who receives repeated valid notices loses publishing rights and the account is closed. Earnings connected to infringing content may be withheld.
Protecting creators from piracy
Content on OnlyThroat is licensed to fans for personal viewing on the platform only. Downloading, recording, reposting or sharing it anywhere else breaks our acceptable use policy and leads to account termination.
If you find OnlyThroat content posted on another website, contact that website through its own copyright process. Creators can email us with the link and we can help with the notice.
Other content concerns
Content that is not about copyright, such as content involving a minor, non-consent or a deepfake of a real person, is handled under our content policy. Use the report page or email [email protected].
